Interpretation

By renting a Vehicle from us, you agree to be bound by these terms and conditions, as well as any additional terms that may apply to your rental.

In these conditions, the following words have the following meanings:

“You” / “the renter” / “customer” refers to the person or entity that is renting a motorcycle from MotoJoe Ltd and its affiliates, including Motorrad Central Ltd.

“Company” / “our” refers to MotoJoe Ltd and its affiliates, including Motorrad Central Ltd, the company that is providing the rental service.

“We” / “us” also refers to MotoJoe Ltd and its affiliates, including Motorrad Central Ltd, and/or their respective employees or representatives

“Motorcycle” refers to the vehicle that is being rented to the customer.

“Rental Period” refers to the time period during which the motorcycle is being rented by the customer.

“Terms and Conditions” refers to the agreement between MotoJoe, Motorrad Central and/or rentamotorcycle.co.uk and the customer regarding the rental of the motorcycle and the responsibilities of each party.

Section 1: Eligibility and Qualifications for Rental

  1. All rentals are subject to our insurer agreeing to provide insurance. If our insurer will not provide insurance due to restrictions or terms and conditions, the rental will be cancelled, and any deposit will be returned in full.

  2. Age Restrictions

    a. You must be at least 25 years of age and at most 70 years of age to hire a motorcycle for solo riding

    b. You must be at least 30 years of age and at most 65 years of age to hire a motorcycle and carry a pillion

    c. If you are over either age limit, we will need to refer to our insurance company, on a case-by-case basis

  3. Riding Experience

    a. You must have held a licence for 2 years minimum for solo riding

    b. You must have held your licence for 3 years minimum to carry a pillion

  4. Insurance Restrictions

    The following is an extract from the conditions our insurers apply to our policy.

    Check you can provide the appropriate level of identification, you are old enough, have the required driving/riding experience, are not excluded due to licence endorsements of criminal convictions and your occupation is not on the list of excluded occupations.

    Please understand the list of excluded occupations (listed below) has been supplied by our insurers.

    We have no control over which occupations our insurers deem “unsuitable”.

    The driving licences listed below are accepted.

    • UK
    • Northern Ireland
    • EU
    • Australia
    • New Zealand
    • Canada
    • USA

    If your licence is not issued from the list above, we will have to refer to our insurance company, on a case-by-case basis.

    If you are unsure about whether you meet the insurance restrictions, please contact us and we will clarify the position.

Section 2: Rental Rates

  1. Rentals are measured in 24-hour periods (or part thereof) with a minimum rental period of 2 days.

  2. Rental rates for the motorcycle, accessories and any other items are as stipulated in the email at the time of booking.

  3. We operate a fair-use mileage policy. If you intend to exceed 300 miles per day (on average over the term of your rental) you must inform us in advance to avoid any additional mileage charges (at 10p per mile).

Section 3: Reservation and Cancellation Policy

  1. We always try to ensure that the motorcycle booked is available for rental. However, if for any reason it should become unavailable, we will inform you promptly and offer an alternative motorcycle from our fleet.

  2. A deposit is required to secure the booking and must be paid 7 days from the date of the email.

  3. You must notify us immediately if you are involved in an accident prior to vehicle pick up involving a motorcycle that you were driving (whether or not one of our motorcycles) and whether or not during a period of hire.

  4. You must notify us prior to vehicle pick up if any of the following occurs:

    a. Your driving licence is endorsed

    b. Your occupation changes to that of a Restricted Occupation

    c. You suffer from a health-related complaint that restricts your ability to drive safely

  5. Cancellations made more than 21 days before the rental start date will be refunded in full.

  6. Cancellations made less than 21 days before the rental start date will not be refunded.

  7. If you change the pickup date or return date to shorten the rental with less than 21 days clear notice, there will be no reduction in the total rental charge.

  8. Any requests to make changes to the reservation cannot be guaranteed. Every effort will be made to accommodate.

  9. UK licence holders

    To rent a motorcycle from us, we require verification of any endorsements and therefore need a DVLA check code from you ahead of your motorcycle rental.

    You need to access the DVLA’s driving licence service: www.gov.uk/view-driving-licence where you can create a licence check code with which you can share your driving record with us.

    To obtain this code, you need:

    1. Your driving licence number
    2. Your NI number; and
    3. Your postcode.

    The code you obtain is a ‘one use’ code and is only valid for 21 days from the time you create it. Please obtain a code within 3 weeks of your rental commencement and email it to us so we can avoid any unnecessary delay when you arrive.

    We are not able to meet the insurance requirements for your rental if we cannot access the information required.

Section 4: Conditions of hire

  1. A rental contract must be fully completed and signed by you.

  2. Payment for all hires must be by credit or debit card at the point of collection if not settled in advance.

  3. We must verify your identity, date of birth and address by:

    • Inspecting and retaining a digital copy of the DVLA Licence Check or inspecting and retaining a copy of a non-UK Licence.
    • Inspecting and retain a photocopy of at least one of the following:
      • Passport
      • Cheque Book
      • Debit or Credit Card
      • Original Utility Bill

    We must check your licence is current/valid for the vehicle being hired and that the address shown on the licence is your current address.

    A photocopy will be taken and retained with the rental agreement.

  4. Unless previously agreed with the insurers:

    a. You must not have:

    • Had more than one fault or partial fault accident in the last 3 years

    • Been disqualified from driving in the last 3 years, including Totting Up (TT99) convictions

    • Any convictions or prosecutions pending under any Road Traffic Act or similar legislation in any country in which this policy is operative unless specifically declared

    • More than 8 unexpired points on your driving licence

    • Been convicted during the last 3 years of an offence for:

      • Reckless / Dangerous (All DD)
      • Drink / Drugs (All DG)
      • Taking / Stealing (All UT)
      • Failing to Stop / Report (All AC)
      • Motor Racing (MS50)
      • Careless Driving (All CD)
      • Mutual Recognition (All MR)
      • No Insurance (All IN)
    • Had a motor insurance proposal declined, a policy cancelled, a renewal refused or special terms, conditions, exclusions, or an increased premium imposed?

    b. You must not be engaged in any of the following occupations:

    • Fast food delivery
    • Professional sport
    • Racing
    • Gambling
    • Modelling or entertainment, other than as a classical musician
    • Hawking or general dealing
    • Street or market trading
    • A student
    • A member of the United Kingdom armed forces aged under 25
    • A member of the armed forces of any other country
    • For the carriage of goods for hire or reward
    • For the carriage of passengers for hire or reward

    c. You must not have any criminal convictions.

    d. You must have a driving licence without any terms or restrictions imposed by the DVLA or DVAS or equivalent for any medical condition requiring notification.

  5. You must not allow the Motorcycle:

    a. to be used to carry passengers for hire, reward or any other kind of remuneration.

    b. to be used to carry goods of a hazardous or dangerous nature or of excessive size or weight.

    c. to be used to propel or tow any motorcycle, trailer, or other object(s) without prior written agreement.

    d. to be used to take place in any race, rally, pace making, trials, speed testing or other contest or any racetrack or off-road facility of any kind.

    e. to be used whilst the driver is under the influence of alcohol, drugs or any substance impairing their consciousness or ability to react: in contravention of any traffic regulations.

    f. to be driven by any other person (including any other Hirer) who has not been authorised by us.

  6. Failure to comply with the conditions of use may result in the charge of the agreed damages payments and/or the recovery of the Motorcycle without notice at your expense.

  7. The motorcycle must remain within the United Kingdom at all times. It may not be taken outside the United Kingdom without our prior written consent, and we may apply an additional insurance charge for such use outside the United Kingdom. In the event we agree to the motorcycle leaving the United Kingdom, it may not be used in any country outside the member states of the European Union, Switzerland, and Norway.

  8. If any accessory (such as a mobile device holder or an electrically powered accessory such as a heated jacket) is fitted to the bike, the costs of repairing any damage, including cosmetic damage, to the motorcycle will be charged to you. Any electrical device powered by the bike must be able to be connected via the bike’s electrical power socket(s). No device should be connected directly to the battery or the wiring harness.

  9. You must not make any alterations of any kind to the Motorcycle.

Section 5: Insurance and Liability

  1. You acknowledge that we provide no personal accident insurance, health insurance or any other similar insurance.

  2. You agree that our liability under all circumstances is limited to the total amount of the fee for the rental of the motorcycle concerned.

  3. Insurance Market

    The insurance market for motorcycle rental in the UK is very limited. If no insurance company is prepared to underwrite motorcycle rental risk on commercial terms, we reserve the right to cancel in whole or part any agreement with you as a result. No compensation will be payable to you for such cancellation and no liability will be accepted for any consequential loss suffered by you. Where you have paid a deposit in advance of receiving services, we will refund the deposit relating to the rental of any motorcycle. Where a deposit relates to services, such as hotel accommodation and we have made payments to such service providers, we will use reasonable endeavours to recover such sums and pass them back to you.

  4. Excess

    It is hereby noted that the policy excess is £2,000 in respect of all Motorcycles.

Section 6: Payment

  1. Securing your booking

    Once a booking is received, you will receive an email confirming the details of the bike requested along with pricing.

    The email also contains further instructions on what you need to do to confirm the reservation:

    • You will need to follow the first link in the email to complete a form with your details.

      This allows us to arrange the necessary insurance for your motorcycle rental

    • You will need to follow the second link in the email to pay the deposit securely online.

    You will need to complete both of the above within 7 days of the date of the email in order to confirm your reservation.

    Until both are complete, your rental is not confirmed.

    Any outstanding balance is then due the day you arrive to collect your motorcycle.

Section 7: Pick-up and Return

  1. At the point of collection, you must produce original copies of your Driving Licence and one other form of photo ID, such as a Passport or National Identity Card. If the current address is not shown on the licence, we will need a separate document as proof of address such as a Utility Bill issued within the last 3 months, Bank Statement issued within the last month, a Local Authority Council Tax Bill for the current year or Electoral Roll Entry. We do not accept Provisional Driving Licences, Mobile Phone Bills or Credit Card Statements as proof of address.

  2. You will have to sign a contract to say you have read, understood and agree with the conditions and that the information you supply is accurate before you can take your rented motorcycle off our premises.

  3. Record Inspection

    It is a condition of this insurance that we can audit your hire records, including individual hire agreements, at any time. You must keep details of hire agreements for at least 48 months.

    Note: we are required to keep your details on file for 48 months to comply with this section.

  4. You must return the motorcycle with a full tank of fuel.

  5. A late fee of £50 per hour will be charged for motorcycles returned past the agreed return time.

Section 8: Fuel and Mileage

  1. The motorcycle will be provided with a full tank of fuel at the time of rental.

  2. You are responsible for refuelling the motorcycle before returning it.

  3. Additional fees apply for refuelling the motorcycle if not returned with a full tank of fuel.

  4. Additional fees apply for excessive mileage during the rental period.

Section 9: Damage and Loss

  1. You agree to pay the excess charge if the bike is stolen, for any damage incurred whilst the motorcycle is in your care, or any fines levied during the rental period in respect of motoring offences or parking violations.

  2. In the event of damage to the motorcycle, whilst it is rented to you, you are liable for the damage up to the excess limit indicated in the rental contract. Repairs to damaged motorcycles are carried out in our workshop following BMW’s best practices. If a bike is returned damaged and the workshop is unable to carry out a full inspection, we will take an immediate minimum payment of 100% of the excess amount. Once the workshop has inspected the bike, we will either retain the full excess amount or issue a refund for the proportional amount, depending on the level of damage. Please see the section below in respect of damage to tyres.

  3. In the event you are involved in an accident involving the motorcycle:

    a. You must inform us immediately

    b. You must provide insurance details to any other party involved and make a statement to the police if anyone suffers any injury in an accident.

    c. You also agree that you will cooperate with any reasonable request from us or our insurers to provide statements and other information in respect of any accident.

    d. You must complete the accident report form, provided by us and, if possible, collect photographic evidence of the accident scene.

  4. If you are involved in any accident which results in a personal injury claim against us or our insurers, as a result of your actions, you will fully indemnify us, and our insurers, for any loss we suffer where such claim is from your pillion passenger or any member of the group with which you are riding or touring.

  5. You must inform us promptly of any notification to you by any relevant authority of any traffic offence or parking violation whilst the motorcycle is in your care.

  6. You will be charged the full retail value of the motorcycle in case of total loss due to negligence, carelessness, or dangerous driving.

Section 10: Penalties and Fees

  1. Tyre damage

    You will be charged (at our cost price) for a plugged, punctured, or damaged tyre proportionate to the amount of tread life remaining. For example, if 60% of a tyre’s tread is remaining, you will be charged 60% of the cost of a new tyre (plus fitting).

    If you have a tyre replaced whilst on rental and produce the invoice for the tyre and the tyre is of the correct make and type for the motorcycle and is a matched pair, there will be no charge.

    If the tyre is not of the correct make or type, then you will be subject to a charge calculated in the same way as for a punctured tyre.

  2. A cleaning fee of £50 will be charged if the motorcycle is returned in an excessively dirty condition.

  3. A fee of £220 will be charged if you lose the motorcycle key or fail to return it.

Section 11. Law and Jurisdiction

The Contract shall be governed by and construed in accordance with Scottish law and in relation to any legal action or proceedings arising out of or in connection with the Contract. Each of the parties submits to the non-exclusive jurisdiction of the Scottish Courts.
